Abstract

Examines the central role of the "declaration" in self-declarations of trust. Reviews the difference between transfers on trust and self-declarations, and compares self-declarations with gifts and constructive trusts. Discusses what constitutes a declaration, its role as a formality, as an intention to be bound, and as an act of communication, and assesses why they are recognised by the courts.
