Abstract

In Israel, every legal procedure requires a payment of court fees. However, in certain situations the court can exempt an applicant this obligation. For individuals and state organs the exemption criteria are set in the Court Fees Regulations. But for corporation the Regulations do not provide guidelines. This paper analyzes the courts' interpretation of the Regulations and its application to corporation vis-à-vis fundamental principles of corporate law. It is suggested that in order to determine the corporation financial ability to pay court fees it is not only needed to examine the corporation’s resources, but also the financial incentives of third parties that support the corporation and have an interest in the suit.
