Abstract

This entry considers the term of ‘exhaustible natural resources’ in Article XX(g) GATT, which provides a basis for justifying measures aimed at the conservation of such resources that are found to be inconsistent with GATT substantive obligations. It examines how this concept has been interpreted and applied in relevant GATT/WTO dispute settlement proceedings, and reflects upon the merits and challenges of the flexible interpretative approach that emerges from this jurisprudence.
