Abstract
Discusses, with reference to case law, how the Contracts (Rights of Third Parties) Act 1999 s.1(1) may confer enforceable rights on third parties without this being intended by the contracting parties, who often exclude it from their terms of business as a result. Reviews the origins of s.1, how courts have interpreted "purports to confer a benefit" and the difficulty of rebutting the presumption that contractors intended third party enforcement.
