Abstract
Discusses Secretary of State for the Home Department v Cox (CA) that a trade union could not enforce a term of an employment contract as a third party, even though the term did "purport to confer a benefit" upon the union within the meaning of the Contracts (Rights of Third Parties) Act 1999 s.1(1)(b) , because on a proper construction of the contract it appeared that the parties did not intend the term to be enforceable by the third party.
