Although protection is not inherently detrimental,\r\nthis conception of child protection harms refugees of all ages. It casts adult\r\nrefugees as less vulnerable, less dependent and less deserving of protection than\r\ntheir younger counterparts. It downplays the contextual, relational and socially\r\nconstructed nature of vulnerability, dependence and childhood. It contributes to\r\nthe disregard for the capacity and wishes of child refugees. It affords these\r\nchildren only temporary protection, thereby increasing their uncertainty, driving\r\nthem to disengage from welfare services and incentivizing the state to delay\r\ndecisions about their entitlements. Meanwhile, international law enshrines child–\r\nparent relations but also authorizes the punishment of supposedly unfit parents,\r\nand this ambivalence helps states weaponize legal principles of child protection\r\nagainst refugee parents and their children. These issues symptomize broader\r\nproblems in international human rights law, international child law and\r\ninternational refugee law.
